TERMS AND CONDITIONS

Generator Collective is looking for videos from the public about how policy has affected them, their families and/or their friends. By submitting a video to Generator Collective, you agree to the terms and conditions of this document.

Video Format

Your video should be approximately 90 seconds in length. The ideal structure would consist of a 10 second introduction with your name, age and background (where you work or go to school), followed by 10 seconds that state where you are from and where you live now. Then, approximately 10 seconds of what you are into/like to do with your free time, followed by 60 seconds of the issue and how it has impacted you, your family and/or your friends. There is no need to worry about production value; Just make sure you have enough lighting so that we can see your face. The videos are meant to tell real stories with a personal touch.

Do’s and Don’ts

  • If you don’t want to provide your full name, it is fine to use just your first name or even a pseudonym.
  • Please don’t provide sensitive information in your video. Your video may be publicly accessible, so be careful about what information you include in your video.
  • If you are concerned about revealing your identity, you may send us your story in writing or by audio (via email to submit@generatorcollective.com and we can create a video based on your story.
  • If your story is about someone else, or references someone else, please be sure that that person has consented to your submitting the video to Generator Collective.
  • Ideally, your video will be a “selfie,” which means that you own the copyright to your video. If someone else records your video for you, please be sure that that person has consented to your submitting the video to Generator Collective.
  • Please do not use any copyrighted material that belongs to a third party without the permission of the copyright owner. That includes music. Please do not include any music in your video without proper permission.
  • Try to avoid using trademarks that belong to a third party as well.

How to Submit your Video to Generator Collective

To submit your video, please email us your video file or a link to your video to submit@generatorcollective.com. Please be sure to provide the required information, including a link to where your video is located on YouTube, Vimeo, Dropbox, Google Drive or other video or file storage platform. Be sure that your video is made “public” so that we can access your video from the site where it resides.

What Generator Collective Will Do with your Video

Generator Collective reserves the right to edit your video as we deem appropriate. Generator Collective also reserves the right not to post or otherwise use your video in our sole discretion. The Generator Collective may post your video to the website located at www.generatorcollective.com and on any of Generator Collective’s social media sites.  In addition, Generator Collective may share your video with policymakers. Generator Collective may also use your video in its own promotional materials.

Changes to this Document

Generator Collective reserves the right to update this document at any time upon posting on the Website. Your submission of a video is subject to the terms and conditions in effect as of the date of your submission.

Other Relevant Policies

Submission of your video is also subject to the Terms and Conditions of Use and Privacy Policy. If you don’t agree with the terms of these three documents, do not submit your video to Generator Collective.

By using and/or visiting the Website, you agree to these Terms and Conditions of Use, as well as Generator Collective’s Privacy Policy. Generator Collective hereby grants you permission to use the Website as set forth in these Terms and Conditions of Use, provided that you use the Website solely for noncommercial use. Generator Collective hereby grants you permission to make copies of any part of the Website (other than videos submitted by other Users) in any medium to use for noncommercial purposes, provided that you retain Generator Collective’s marks and copyright notices on your copy. You must obtain Generator Collective’s prior consent to use any of the content on the Website for any other purposes. In addition, your use of the Website is conditioned upon your complete compliance with these Terms and Conditions of Use.  

 

Restrictions on Use

You agree not to use or launch any automated system, including without limitation, "robots," "spiders," "offline readers," etc., that accesses the Website in a manner that sends more request messages to Generator Collective’s servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, Generator Collective grants the operators of public search engines permission to use spiders to copy materials from the Website for the sole purpose of creating publicly available searchable indices of the materials. Generator Collective reserves the right to revoke these exceptions either generally or in specific cases. You agree not to collect or harvest any personally identifiable information from the Website, nor to use the communication systems provided by the Website for any commercial solicitation purposes. You agree not to solicit any users of the Website for any commercial purposes.

Indemnity

You agree to defend, indemnify and hold harmless Generator Collective, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees) arising from: (i) your use of and access to the Website; (ii) your violation of any term of these Terms and Conditions of Use; (iii) your violation of any third party right or any law, including without limitation any copyright, property, or privacy right; or (iv) any claim that content you submit via the Website violates any third party right or any law. This defense and indemnification obligation will survive these Terms and Conditions of Use and your use of the Website.

 

Assignment

These Terms and Conditions of Use, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Generator Collective without restriction.

 

Ability to Accept Terms and Conditions of Use

You affirm that you have reached the age of majority in your jurisdiction or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions of Use, and to abide by and comply with these Terms and Conditions of Use. In any case, you affirm that you are at least 13 years of age, as the Website is not intended for children under 13. 

 

General

These Terms and Conditions of Use shall be governed by the internal substantive laws of the State of New York, without respect to its conflict of laws principles. Any claim or dispute between you and Generator Collective that arises in whole or in part from the Website shall be decided exclusively by a court of competent jurisdiction located in the State of New York. These Terms and Conditions of Use, together with the Privacy Policy and any other legal notices published by Generator Collective on the Website, shall constitute the entire agreement between you and Generator Collective concerning the Website. If any provision of these Terms and Conditions of Use is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions of Use, which shall remain in full force and effect. No waiver of any term of this these Terms and Conditions of Use shall be deemed a further or continuing waiver of such term or any other term, and Generator Collective’s failure to assert any right or provision under these Terms and Conditions of Use shall not constitute a waiver of such right or provision. YOU AND GENERATOR COLLECTIVE AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE WEBSITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

This Privacy Policy governs the manner in which Generator Collective collects, uses, maintains and discloses information collected from users (“You” or “Users”) of its website located at http://www.generatorcollective.com (the “Website”). 

The Types of Information Generator Collective Collects

Generator Collective may collect non-personally identifiable information about you whenever you visit its Website. Generator Collective collects personally identifiable information, such as names, email addresses and zip codes, from Users when they voluntarily provide such information to us, including, for example, when Users sign up for our newsletter, send us an email or complete the online form required to be able to submit a video to us.  

How Generator Collective Uses the Information that It Collects

Generator Collective uses Users’ personal information to better understand how Users use the Website so that Generator Collective can improve the Website and its offerings. Generator Collective also uses Users’ personal information for the purpose for which the Users provided the information, in other words, to respond to an inquiry or to review your video submission. If you provide us with your email address, we may sign you up to receive newsletters from Generator Collective. If at any time you wish to stop receiving communications from Generator Collective, please follow the unsubscribe instructions at the bottom of any email Generator Collective sends you, or send Generator Collective an email at hello@generatorcollective.com and ask to be removed from Generator Collective’s email list. 

How Generator Collective Protects User Information

Generator Collective adopts appropriate data collection, storage and processing practices and security measures to help protect against unauthorized access, alteration, disclosure or destruction of your personal information, but Generator Collective cannot guarantee that your information is 100% secure. 

Sharing Personal Information

Generator Collective may post your videos on the Website, and may share your videos with policymakers. We may include your name and zip code in connection with the use of your videos, unless you ask that we not do so. In addition, Generator Collective may share User’s personal information with other like-minded organizations.

Generator Collective may use third party service providers to help us operate the Website or administer activities on Generator Collective’s behalf. These third party vendors may have access to User information but they are required to protect the confidentiality of the information and to use it only for the limited purpose for which it was provided.

In addition, Generator Collective will share personally identifiable information about Users when required to do so by law, or in the good faith belief that such action is necessary to comply with state and federal laws or to respond to a court order, subpoena, or search warrant. Generator Collective will also share personally identifiable information if we believe it is necessary to protect the rights, property and safety of us or others.

Generator Collective may also share personally identifiable information in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company. Moreover, Generator Collective may share personally identifiable information about a User upon the User’s consent.

Generator Collective may share generic aggregated demographic information not linked to any personally identifiable information regarding Users with third parties. 

Third Party Websites

Generator Collective may provide links from the Website to other websites. Generator Collective does not control the content or links that appear on these third party websites and is not responsible for the practices employed by websites linked to or from the Website. These websites and services have their own privacy policies. Browsing and interaction on any other website, including websites that have a link to or from Generator Collective’s Website, is subject to that website’s own terms and policies. This Privacy Policy covers only information collected through the use of Generator Collective’s Website. In addition, Generator Collective does not currently respond to web browser “do not track” signals. 

Compliance with Children’s Online Privacy Protection Act

Protecting the privacy of the young is especially important. For that reason, Generator Collective never collects information at the Website from those Generator Collective knows are under 13, and no part of the Website is structured to attract anyone under 13. If Generator Collective becomes aware of having information about anyone under 13, Generator Collective will promptly delete the information.

California Privacy Rights

If you reside in California and have provided your personally identifiable information to Generator Collective, you may request information once per calendar year about Generator Collective’s disclosures of certain categories of your personally identifiable information to third parties for their direct marketing purposes. Such requests must be submitted to Generator Collective at submit@generatorcollective.com.

Generator Collective may update this Privacy Policy at any time. When it does, Generator Collective will revise the updated date at the bottom of this page.
